Jinchang Municipal Bureau of Justice Functional Information

Pursuant to the Notice of the General Office of the CPC Gansu Provincial Committee and the General Office of the People's Government of Gansu Province on Issuing the Plan for the Transformation of Functions and Institutional Reform of the People's Government of Jinchang City (Gan Ban Zi [2014] No. 41) and the Notice of the General Office of the CPC Jinchang Municipal Committee and the General Office of the People's Government of Jinchang City on Issuing the Implementation Opinions on the Plan for the Transformation of Functions and Institutional Reform of the People's Government of Jinchang City (Shi Wei Ban Fa [2014] No. 101), The Jinchang Municipal Bureau of Justice is hereby established as a functional department of the municipal government.


I. Primary Responsibilities


Implement laws, regulations, and relevant policies concerning judicial administration work of the Party and the state; formulate medium- and long-term plans and annual work programmes for judicial administration across the city and oversee their implementation; participate in related legislative work.


(1) Undertake policy research on major issues concerning comprehensive law-based governance of the city; coordinate relevant parties to propose medium- and long-term planning recommendations for comprehensive law-based governance; oversee the implementation of major policy deployments.


(2) Undertake responsibility for coordinating legislative planning. Coordinate with relevant parties to propose legislative planning and annual legislative work plans, monitor the implementation of legislative work plans by various departments, strengthen organisational coordination and supervision, and propose opinions and measures to ensure alignment between legislation and reform decisions. Oversee the solicitation of proposals for local regulations and government rules from the public.


(iii) Draft or organise the drafting of relevant local regulations and municipal government rules. Review draft local regulations and municipal government rules submitted by departments to the municipal government. Coordinate legislative matters. Conduct legality reviews of normative documents issued by the municipal government.


(iv) Undertake the interpretation of municipal government regulations. Conduct post-implementation evaluations of relevant local regulations and municipal government regulations. Coordinate disputes and issues arising from the implementation of local regulations and municipal government regulations by counties, districts, and departments. Undertake the review and compilation of local regulations and municipal government regulations drafted by the municipal government, and organise the translation and approval of official foreign-language and ethnic minority language versions of relevant local regulations and municipal government regulations. Responsible for the filing and review of normative documents issued by county/district governments and municipal departments. Organises the review of local regulations and rules.


(5) Assumes responsibility for advancing the rule of law in government administration. Guides and supervises the lawful administration of municipal departments and county/district governments. Coordinates administrative law enforcement, drives reforms to the administrative law enforcement system, and promotes strict, standardised, fair and civilised law enforcement. Handle administrative reconsideration and administrative litigation matters submitted to the municipal government, manage litigation cases, and guide and supervise county/district administrative reconsideration and litigation work. Regulate administrative law enforcement procedures, administrative law enforcement conduct, and administrative discretion; review the qualifications of administrative law enforcement entities and personnel within municipal departments; guide and supervise administrative law enforcement across counties/districts and departments.


(6) Undertakes responsibility for coordinating the planning of rule-of-law society development. In accordance with the unified arrangements of the Central Committee and the Provincial Party Committee, formulates implementation plans for rule-of-law publicity and education, organises and implements legal awareness campaigns. Promotes public participation in and advancement of rule-of-law development. Guides work on governance according to law and rule-of-law creation initiatives. Oversees mediation work and the selection and management of lay assessors and public supervisors, while advancing the development of judicial offices.


(7) Guides and manages community correction work across the city. Oversee the rehabilitation and resettlement of released prisoners citywide. Coordinate matters pertaining to Jinchang Prison.


(8) Formulate and implement the citywide public legal service system development plan, coordinating and allocating legal service resources across urban and rural areas and regions. Guide and supervise the establishment of public legal service centres, overseeing the work of solicitors, legal aid, judicial appraisal, notarial services, arbitration, and grassroots legal services. Conduct foreign-related legal services in accordance with national directives.


(IX) Oversee the organisation and implementation of the National Unified Legal Profession Qualification Examination across the city. Manage the city's National Unified Legal Profession Qualification and certification administration. Plan and guide pre-service training for legal professionals.


(X) Manage the municipal government's legal advisory services. Conduct legality reviews of major administrative decisions made by the municipal government. Represent the municipal government in administrative litigation and related legal matters where the municipal government is a civil party. Handle legal consultation matters for the municipal government. Organise theoretical research and publicity efforts for building a law-based government.


(11) Oversees uniform management, police vehicle administration, and information technology development within the system. Directs and supervises support functions including finance, equipment, facilities, and premises management.


(12) Guides Party building, team development, and ideological work within the system. Plans, coordinates, and directs efforts related to the development of rule-of-law talent. Guides and supervises Party building within the city's legal services sector. Directs spiritual civilisation initiatives. Assists county and district authorities in managing leading cadres of judicial bureaus.
