(1) Oversee comprehensive market supervision and management. Implement national, provincial, and prefectural laws, regulations, local statutes, rules, and policies concerning market supervision and intellectual property. Organize and implement strategies for quality enhancement, intellectual property strengthening, food and drug safety, and standardization. Draft and execute relevant plans to regulate and maintain market order, fostering an environment of integrity and fair competition.
(2) Oversee unified registration of market entities. Guide registration procedures for enterprises, farmer cooperatives, business units, individual industrial and commercial households, and permanent representative offices of foreign (regional) enterprises. Establish information disclosure and sharing mechanisms for market entities, legally publish and share relevant data, strengthen credit-based supervision, and advance the construction of a market entity credit system.
(3) Guide and promote the implementation of policies and measures supporting micro-enterprise development. Undertake the daily operations of the Prefecture Leading Group Office for Supporting Micro-Enterprise Development.
(4) Organize and guide comprehensive market regulation enforcement. Guide the development of comprehensive market regulation enforcement teams in counties (cities, new districts), and promote unified market regulation. Coordinate the investigation and handling of major and complex cases, as well as cross-regional enforcement activities. Standardize market regulation and intellectual property administrative enforcement practices.
(5) Oversee unified antitrust enforcement within its authority. Coordinate the implementation of competition policies and guide the implementation of fair competition review systems. Conduct antitrust reviews of business concentration activities within its authority. Enforce antitrust laws regarding monopolistic agreements, abuse of market dominance, and abuse of administrative power to exclude or restrict competition.
(6) Oversee market order. Supervise market transactions, online commodity transactions, and related services in accordance with the law. Guide investigations into violations of pricing and fee regulations, unfair competition, illegal direct selling, pyramid schemes, infringement of trademark and patent intellectual property rights, and the production and sale of counterfeit and shoddy goods. Guide the development of the advertising industry and supervise advertising activities. Guide investigations into unlicensed production and operation activities and related uncertified production and operation activities. Guide the Qianxinan Prefecture Consumers Association in conducting consumer rights protection work. Undertakes the daily operations of the Prefecture Joint Conference Office for Combating Pyramid Schemes and Regulating Direct Selling.
(7) Oversees macro-level quality management. Formulates and implements institutional measures for quality development. Coordinates the construction and application of the prefecture-wide quality infrastructure. Collaborates with relevant departments to implement quality supervision systems for major engineering equipment. Organizes investigations into major quality incidents. Implements the defective product recall system. Supervises and manages product anti-counterfeiting efforts. Undertakes the daily operations of the Qianxinan Prefecture Quality Development Leading Group Office.
(8) Oversee product quality and safety supervision. Manage product quality and safety risk monitoring and prefectural-level supervisory sampling. Implement quality grading systems and quality safety traceability systems. Guide industrial product production licensing management. Oversee fiber quality supervision.
(9) Oversee special equipment safety supervision. Manage special equipment safety inspections and supervision comprehensively. Monitor compliance with energy-saving standards for high-energy-consuming special equipment and environmental protection standards for boilers.
(10) Oversee comprehensive coordination of food safety supervision and management. Organize the formulation and implementation of major food safety policies across the prefecture. Build the food safety emergency response system, organize and guide emergency response and investigation of major food safety incidents. Establish and improve the direct reporting system for critical food safety information. Undertake the daily operations of the Prefectural Government Food Safety Committee Office.
(11) Oversee food safety supervision and management. Establish and implement a supervision and inspection system covering the entire process of food production, distribution, and consumption, along with a mechanism for identifying and addressing hidden dangers, to prevent regional and systemic food safety risks. Promotes mechanisms for food producers and operators to fulfill their primary responsibilities and improves the food safety traceability system. Organizes and implements food safety supervision sampling, risk monitoring, verification and disposal, risk warning, and risk communication. Oversees the supervision and management of special foods.
(12) Responsible for the unified management of measurement work. Promotes the use of legal measurement units and the national measurement system, manages measuring instruments, and oversees measurement value transmission and comparison. Regulates and supervises commodity quantities and market measurement practices.
(13) Oversee the unified management of standardization. Organize the formulation of prefectural-level local standards in accordance with the law, coordinate, guide, and supervise the development of county-level local standards, group standards, and enterprise standards. Participate in the formulation of international standards, national standards, and provincial-level local standards, and organize the adoption of international standards. Manage prefectural-level specialized standardization technical committees.
(14) Oversee the unified management of inspection and testing. Advance the reform of inspection and testing institutions, regulate the inspection and testing market, improve the inspection and testing system, and guide and coordinate the development of the inspection and testing industry.
(15) Oversee the unified management, supervision, and comprehensive coordination of certification and accreditation. Implement the nationally unified certification, accreditation, and conformity assessment supervision system.
(16) Draft and implement policies, measures, and development plans for building a strong intellectual property (IP) prefecture. Advance the implementation of management policies and systems for IP creation, protection, and utilization. Promote the development of public IP service systems and organize the dissemination and utilization of IP information such as trademarks and patents. Undertake the daily operations of the Prefectural People's Government IP Office Meeting System.
(17) Protect intellectual property rights. Implement systems for protecting trademarks, patents, geographical indications of origin, and other intellectual property rights. Research policies to encourage intellectual property protection, management, and services for innovation in new fields, new business models, and new formats. Implement plans for building an intellectual property protection system and promote its development. Guide trademark and patent registration and enforcement efforts, and oversee the handling of intellectual property disputes, rights protection assistance, and dispute mediation.
(18) Promote the utilization of intellectual property. Formulate policies for intellectual property utilization and standardized transactions to facilitate the transfer and transformation of intellectual property. Advance intellectual property evaluations for major economic activities and related work for overseas transfers. Guide the valuation of intellectual property intangible assets. Foster the development of intellectual property services. Coordinate major intellectual property activities.
(19) Oversee science and technology, informatization, publicity, emergency response, and public opinion monitoring for market supervision. Undertake technical trade measures-related work as stipulated.
(XX) Oversee safety supervision of pharmaceuticals (including traditional Chinese medicine and ethnic medicines, as applicable), medical devices, and cosmetics during circulation and use. Draft local regulations and rules, formulate supervisory policies and plans, and oversee their implementation. Implement management and service policies encouraging new technologies and products in pharmaceuticals, medical devices, and cosmetics.
(21) Oversees the management of standards for drugs, medical devices, and cosmetics. Supervises the implementation of national pharmacopoeia standards and other drug, medical device, and cosmetic standards, as well as the classification management system. Cooperates in implementing the national essential drugs system.
(22) Manages licensing, inspection, and penalties for retail drug sales and medical device operations, as well as inspection and penalties for cosmetic operations and the quality of drugs and medical devices during use.
(23) Manages post-market risks for drugs, medical devices, and cosmetics. Organize the monitoring, evaluation, and handling of adverse drug reactions, adverse medical device events, and adverse cosmetic reactions. Undertake emergency management for drug, medical device, and cosmetic safety in accordance with the law.
(24) Responsible for organizing and implementing supervision and inspection of drugs, medical devices, and cosmetics. Investigate and penalize illegal activities in the operation and use of drugs, medical devices, and cosmetics according to its responsibilities.
(25) Responsible for international exchange and cooperation in the field of drug, medical device, and cosmetic supervision and management.
(26) Provide guidance to market supervision departments at the county (city, new district) level.
(27) In accordance with departmental responsibilities, advance work related to military-civilian integration and poverty alleviation. Increase investment in science and technology to enhance innovation capabilities, providing support for innovation-driven development. Oversee work safety and fire safety within the department and its industry sectors. Manage big data development and application, as well as government data resource management in accordance with regulations, promoting the standardized management, sharing, and openness of departmental government data resources.
(XXVIII) Complete other tasks assigned by the Prefectural Party Committee, Prefectural Government, Provincial Market Supervision Administration (Provincial Intellectual Property Office), and Provincial Drug Administration.
(29) Adjustment of Responsibilities. The specific duties of the Prefectural People's Government Food Safety Committee Office shall be undertaken by the Prefectural Market Regulation Bureau. The price supervision and inspection duties and anti-monopoly enforcement responsibilities of the Prefectural Development and Reform Commission, the anti-monopoly-related responsibilities of the Prefectural Commerce Bureau, and the intellectual property management responsibilities of the Prefectural Science and Technology Bureau shall be integrated and transferred to the Prefectural Market Regulation Bureau (Prefectural Intellectual Property Bureau). The administrative functions undertaken by subordinate public institutions shall be reclaimed by the administrative organs.
