 Gansu Provincial Department of Justice Functional Information

The Department of Justice of Gansu Province is a constituent department of the provincial government at the deputy ministerial level.

The Office of the Provincial Committee for Comprehensive Law-Based Governance of Gansu Province (hereinafter referred to as the Provincial Office for Law-Based Governance) is established within the Department of Justice. It operates under the direct leadership of the Committee, undertakes its specific tasks, organizes policy research on major issues concerning comprehensive law-based governance at the national and provincial levels, and coordinates efforts to ensure relevant parties implement the Committee's decisions, work arrangements, and requirements. A Secretariat of the Provincial Committee Office for Comprehensive Law-Based Governance is established to handle its daily operations. Internal departments of the Provincial Department of Justice undertake relevant tasks for the Provincial Committee Office as required and accept its overall coordination.


Primary Responsibilities:

(1) Conduct policy research on major issues concerning comprehensive law-based governance at the provincial level; coordinate relevant parties to propose medium- and long-term planning recommendations for comprehensive law-based governance; oversee the implementation of major policy decisions and deployments.

(2) Oversee the planning of legislative work. Coordinate relevant parties to propose legislative plans and annual legislative work programs; monitor the implementation of legislative work plans by various departments; strengthen organizational coordination, supervision, and guidance; and propose opinions and measures to ensure alignment between legislation and reform decisions. Solicit suggestions from the public for local regulations and government rules drafting projects.

(3) Draft or organize the drafting of relevant local regulations and provincial government rules. Review draft local regulations and provincial government rules submitted by departments to the provincial government. Coordinate legislative activities. Conduct legal reviews of normative documents issued by the provincial government.

(4) Handles the interpretation of provincial government regulations. Conducts post-implementation evaluations of relevant local regulations and provincial government regulations. Coordinates disputes and issues arising from the implementation of local regulations and provincial government regulations across regions and departments. Undertakes the review and compilation of local regulations and provincial government regulations drafted by the provincial government, and organizes the translation and approval of official foreign-language and ethnic-language versions of relevant local regulations and provincial government regulations. Responsible for reviewing and filing municipal and prefectural government regulations, normative documents, and normative documents of provincial departments. Organizes the review and cleanup of relevant local regulations and rules.

(5) Assumes responsibility for coordinating the advancement of rule-of-law government construction. Guides and supervises the lawful administration of provincial government departments and local governments at all levels. Coordinates administrative law enforcement comprehensively, undertakes tasks related to advancing administrative law enforcement system reform, and promotes strict, standardized, fair, and civilized law enforcement. Handles administrative reconsideration cases submitted to the provincial government and manages litigation cases. Guides and supervises municipal and prefectural-level administrative reconsideration and litigation defense work. Regulates administrative law enforcement procedures, conduct, and discretionary authority; reviews the qualifications of administrative law enforcement entities and personnel under provincial departments; guides and supervises administrative law enforcement across regions and departments.

(6) Undertakes responsibility for coordinating the planning of a law-based society. In accordance with the unified arrangements of the central authorities, formulates implementation plans for legal publicity and education, and organizes the implementation of legal awareness campaigns. Promotes public participation in and advancement of the rule of law. Guides efforts in law-based governance and the creation of law-based environments. Guides mediation work and the selection and management of people's jurors and people's supervisors, and advances the development of judicial offices.

(7) Guide and supervise prison management across the province; oversee the execution of criminal penalties and prisoner rehabilitation; guide and manage community correction work province-wide. Guide the rehabilitation and placement of released prisoners throughout the province.

(8) Manage judicial administrative drug rehabilitation facilities province-wide. Guide and supervise the enforcement of compulsory isolation rehabilitation and rehabilitation efforts within the system. Provide guidance, support, and assistance for community-based drug rehabilitation and recovery programs.

(9) Drafts and implements provincial plans for public legal service system development, coordinating and allocating legal service resources across urban/rural areas and regions. Guides and supervises public legal service center construction. Oversees lawyers, legal aid, judicial appraisal, notary services, arbitration, and grassroots legal services. Conducts foreign-related legal services per national directives.

(10) Responsible for organizing and implementing the National Unified Legal Professional Qualification Examination throughout the province. Oversees the administration of the National Unified Legal Professional Qualification and certificates. Plans and guides pre-service training for legal and law enforcement personnel.

(11) Responsible for the legal advisory services to the Provincial Government. Conducts legal reviews of major administrative decisions made by the Provincial Government. Represents the Provincial Government in administrative litigation and related legal matters where the Provincial Government is a civil party. Handles legal consultation matters for the Provincial Government. Organizes theoretical research and publicity efforts on building a law-based government.

(12) Oversees the management of firearms, ammunition, and police vehicles within the system, as well as information technology development. Guides and supervises support functions including finance, equipment, facilities, and premises within the system.

(13) Guides Party building, team development, and ideological and political work within the system. Manages police administration and police supervision within the system. Plans, coordinates, and guides the development of legal talent. Guides and supervises Party building within the province's legal services industry. Guides the advancement of spiritual civilization. Oversees the management of retired personnel within the system. Assists prefecture-level cities in managing the leadership teams of judicial bureaus.

(14) Administers the Provincial Prison Administration Bureau and the Provincial Drug Rehabilitation Administration Bureau.

(15) Completes other tasks assigned by the Provincial Party Committee, Provincial Government, and the Ministry of Justice.
