Jiayuguan Municipal Bureau of Ecology and Environment Functional Information

The Jiayuguan Municipal Ecology and Environment Bureau (hereinafter referred to as the Municipal Ecology and Environment Bureau) is a functional department of the municipal government, operating at the deputy director-general level.The Municipal Ecology and Environment Bureau implements the guiding principles, policies, and decisions of the Central Committee of the Communist Party of China, the Provincial Party Committee, and the Municipal Party Committee concerning ecological and environmental protection. In discharging its duties, it upholds and strengthens the Party's centralised and unified leadership over ecological and environmental protection work. Its principal responsibilities are:


(1) To be responsible for establishing and improving relevant ecological and environmental systems. Implementing national and provincial laws, regulations, policies, and fundamental systems concerning ecological and environmental protection; formulating and implementing city-wide ecological and environmental policies and plans in collaboration with relevant departments; drafting local regulations and municipal government rules pertaining to ecological and environmental protection. Coordinating with relevant departments to develop and oversee the implementation of ecological and environmental plans for key areas, river basins, and drinking water sources, as well as water functional zoning; implementing national ecological and environmental standards, benchmarks, and technical specifications; organising the drafting of local ecological and environmental standards for the city; and formulating city-wide technical specifications for ecological and environmental protection.


(2) Overseeing coordination and supervision of major ecological and environmental issues. Assist in investigating and handling major and particularly serious environmental pollution incidents and ecological destruction events. Lead coordination in investigating and handling significant environmental pollution incidents and ecological destruction events. Guide and coordinate emergency response and early warning efforts for significant sudden ecological and environmental incidents. Implement the ecological and environmental damage compensation system. Coordinate resolution of cross-regional and cross-basin environmental pollution disputes. Coordinate ecological and environmental protection efforts in key regions and watersheds.

(iii) Oversee the implementation of emission reduction targets. Implement national total pollutant emission control and pollutant discharge permit systems, determine the carrying capacities for air and water pollutants, enforce total pollutant emission control indicators, monitor progress towards emission reduction targets, and implement the ecological and environmental protection target responsibility system.

(iv) Proposing the scale and direction of fixed asset investment in the ecological and environmental sector, and formulating opinions on the allocation of national, provincial and municipal fiscal funds. Approving, declaring and authorising fixed asset investment projects within the scope of plans and annual programmes according to prescribed authority, while coordinating with relevant departments to ensure implementation and supervision. Participating in guiding and promoting the development of circular economy and ecological environmental protection industries.

(v) Overseeing environmental pollution prevention and control: Implement national management systems for air, water, soil, noise, light, odour, solid waste, chemical, and motor vehicle pollution control. Formulate municipal pollution prevention and control management systems and supervise their implementation. Jointly oversee drinking water source ecological protection with relevant departments, strengthen discharge outlet management to prevent groundwater pollution. Organise and guide comprehensive urban-rural ecological environment remediation, supervising agricultural non-point source pollution control. Oversee and guide regional atmospheric environmental protection efforts, implementing collaborative mechanisms for joint prevention and control of regional air pollution.

(vi) Guide, coordinate, and supervise ecological conservation and restoration. Organise the formulation of ecological conservation plans, overseeing natural resource development activities impacting the ecological environment, key ecological infrastructure projects, and ecological damage restoration initiatives. Implement ecological and environmental supervision systems for all types of nature reserves, formulate municipal-level supervision systems for such reserves, and oversee enforcement. Supervise wildlife conservation, wetland ecological protection, and desertification control. Guide, coordinate, and supervise rural ecological and environmental protection; oversee environmental safety of biotechnology; lead work on biological species (including genetic resources); coordinate biodiversity conservation; and participate in ecological compensation mechanisms.

(vii) Overseeing nuclear and radiation safety. Implementing relevant national policies, plans, and standards; collaborating on nuclear safety coordination mechanisms; participating in nuclear accident emergency response; and managing radiation environmental accident emergency response. Supervising the safety of nuclear facilities and radiation sources; assisting higher-level ecological and environmental authorities in overseeing pollution prevention in nuclear facilities, nuclear technology applications, electromagnetic radiation, and the development of radioactive mineral resources.

(viii) Overseeing ecological and environmental access. Conducting environmental impact assessments for major economic and technological policies, development plans, and significant economic development projects as delegated by the municipal government. Approving or reviewing environmental impact assessment documents for major development zones, plans, and projects in accordance with regulations. Formulating and implementing the ecological and environmental access list.

(ix) Managing ecological and environmental monitoring. Implement the national ecological and environmental monitoring system, enforce national monitoring standards, relevant specifications, and technical norms. Collaborate with higher-level ecological and environmental authorities in conducting ecological and environmental quality monitoring, supervisory monitoring of pollution sources, greenhouse gas emission reduction monitoring, and emergency response monitoring. Organise and implement local ecological and environmental law enforcement monitoring. Conduct investigations, assessments, early warnings, and forecasts of the city's ecological and environmental quality status. Construct and manage the ecological and environmental monitoring network and information network. Establish and implement an ecological and environmental quality announcement system, uniformly publishing municipal-level comprehensive ecological and environmental reports and significant ecological and environmental information.

(10) Responsible for climate change response. Implements national major strategies, plans, and policies on climate change response and greenhouse gas reduction. Cooperates with higher-level ecological and environmental authorities in international exchanges and cooperation on ecological and environmental protection, and in fulfilling obligations under relevant international treaties.

(11) Prepares for and rectifies issues arising from ecological and environmental protection inspections. Collaborates with relevant departments to assist in central and provincial-level ecological and environmental protection inspections of the city, and establishes and improves a rectification system for feedback from such inspections. Conduct oversight of all relevant municipal departments' implementation of central and provincial Party committee decisions on ecological and environmental protection, as well as rectification of feedback from central and provincial inspections.


(12) Exercise unified responsibility for ecological and environmental supervision and law enforcement. Organise city-wide ecological and environmental protection law enforcement inspections. Investigate and address major ecological and environmental violations. Develop comprehensive administrative law enforcement teams and operational capabilities in accordance with requirements from higher-level ecological and environmental authorities.


(13) Organise, guide, and coordinate ecological and environmental publicity and education. Implement national and provincial ecological and environmental protection publicity and education guidelines; organise publicity campaigns on ecological and environmental laws and regulations; promote the participation of social organisations and the public in ecological and environmental protection. Advance ecological and environmental science and technology work; implement national ecological and environmental protection technology policies and technological development plans; organise scientific research on ecological and environmental protection; oversee the promotion of advanced technologies for ecological and environmental protection and remediation; participate in guiding and promoting the development of circular economy, clean production, and environmental protection industries across the city.


(14) Accomplish other tasks assigned by the Municipal Party Committee, Municipal Government, and Provincial Department of Ecology and Environment.


(15) Functional Transformation. The Municipal Ecology and Environment Bureau shall exercise unified oversight and administrative enforcement responsibilities for ecological and urban-rural pollution emissions. It shall earnestly fulfil regulatory duties, comprehensively implement action plans for air, water, and soil pollution prevention and control, enforce national policies to substantially reduce imported solid waste types and volumes, and rigorously combat smuggling of foreign waste. Establish an ecological and environmental governance system led by the government, with enterprises as the main body, and involving the participation of social organisations and the public. Implement the most stringent ecological and environmental protection systems, strictly adhere to ecological protection red lines and environmental quality bottom lines, resolutely fight the battle against pollution prevention and control, and safeguard the security of the national ecological security barrier.
