Pursuant to the spirit of the Notice of the General Office of the CPC Gansu Provincial Committee and the General Office of the People's Government of Gansu Province on Issuing the Provisions on the Functional Configuration, Internal Organizational Structure, and Staffing of the Gansu Provincial Department of Ecology and Environment (Gan Ban Zi [2019] No. 10), the Gansu Provincial Department of Ecology and Environment (hereinafter referred to as the Provincial Department of Ecology and Environment) is a constituent department of the provincial government at the director-general level, retaining the nameplate of the Gansu Provincial Nuclear Safety Bureau for external use. The Provincial Department implements the guiding principles, policies, and decisions of the Party Central Committee and the Provincial Party Committee regarding ecological and environmental protection. In performing its duties, it upholds and strengthens the Party's centralized and unified leadership over ecological and environmental protection work.
I. Primary Responsibilities:
(1) Responsible for establishing and improving relevant ecological and environmental systems. Implement national laws, regulations, policies, and fundamental systems concerning ecological and environmental protection. Collaborate with relevant departments to formulate and implement provincial ecological and environmental policies and plans, and draft local regulations and provincial government rules. Jointly develop and oversee the implementation of ecological and environmental plans for key regions, river basins, and drinking water sources, as well as water functional zoning. Implement national ecological and environmental standards, benchmarks, and technical specifications. Draft provincial ecological and environmental standards and formulate technical specifications.
(2) Oversee the coordination and supervision of major ecological and environmental issues. Assist in investigating and handling major and particularly serious environmental pollution incidents and ecological destruction events. Lead the coordination of investigations and handling for significant environmental pollution incidents and ecological destruction events. Guide and coordinate municipal and prefectural governments in emergency response and early warning for significant sudden ecological and environmental incidents. Implement the ecological and environmental damage compensation system. Coordinate the resolution of cross-regional and cross-basin environmental pollution disputes. Coordinate ecological and environmental protection efforts in key regions and watersheds.
(3) Oversee the implementation of emission reduction targets. Implement national total pollutant emission control and pollutant discharge permit systems, determine the pollution capacity of the atmosphere, water bodies, and other environments, enforce total pollutant emission control indicators, supervise and inspect the fulfillment of pollutant reduction tasks across regions, and implement the ecological and environmental protection target responsibility system.
(4) Propose fixed-asset investment scales and directions in the ecological environment sector, as well as arrangements for national and provincial fiscal funds. Approve, report, and authorize fixed-asset investment projects within planned and annual scales according to provincial government authority. Collaborate with relevant departments on implementation and supervision. Participate in guiding and promoting circular economy and ecological environment protection industries.
(5) Oversee environmental pollution prevention and control. Implement national management systems for air, water, soil, noise, light, odor, solid waste, chemical, and motor vehicle pollution control. Develop provincial pollution prevention and control management systems and supervise their implementation. Jointly oversee drinking water source ecological protection with relevant departments. Organize and guide comprehensive urban and rural ecological environment remediation. Supervise and guide agricultural non-point source pollution control. Oversee regional air environmental protection and implement regional air pollution joint prevention and control mechanisms.
(6) Guide, coordinate, and supervise ecological protection and restoration efforts. Organize the formulation of ecological protection plans; oversee natural resource development activities impacting the ecological environment, key ecological environment construction projects, and ecological damage restoration work. Implement national ecological environment supervision systems for all types of nature reserves, formulate provincial supervision systems for such reserves, and oversee enforcement. Supervise wildlife protection, wetland ecological conservation, and desertification control. Guide, coordinate, and supervise rural ecological environment protection; oversee environmental safety of biotechnology; lead work on biological species (including genetic resources); coordinate biodiversity conservation; and participate in ecological compensation mechanisms.
(7) Overseeing nuclear and radiation safety. Implementing national policies, plans, and standards; leading coordination mechanisms for nuclear safety; participating in nuclear accident emergency response; and managing radiation environmental accident emergency response. Supervising the safety of nuclear facilities and radioactive sources; overseeing pollution prevention in nuclear facilities, nuclear technology applications, electromagnetic radiation, and the development of radioactive mineral resources. Participate in the supervision and management of nuclear material control and the design, manufacture, installation, and non-destructive testing of civilian nuclear safety equipment.
(8) Oversee ecological and environmental access. Conduct environmental impact assessments for major economic and technological policies, development plans, and major economic development projects as entrusted by the provincial government. Approve or review environmental impact assessment documents for major development zones, plans, and projects as stipulated. Draft and implement the ecological and environmental access list.
(IX) Oversee ecological and environmental monitoring. Implement the national ecological and environmental monitoring system, enforce national monitoring standards, specifications, and technical norms, and coordinate with relevant departments to uniformly plan the establishment and management of provincial-level ecological and environmental quality monitoring stations. Organize and implement ecological and environmental quality monitoring, pollution source surveillance monitoring, greenhouse gas emission reduction monitoring, and emergency monitoring. Conduct investigations, evaluations, early warnings, and forecasts of the province's ecological and environmental quality status. Organize the construction and management of the provincial ecological and environmental monitoring network and the provincial ecological and environmental information network. Establish and implement an ecological and environmental quality announcement system, uniformly releasing provincial-level comprehensive ecological and environmental reports and major ecological and environmental information.
(10) Responsible for climate change response. Implement national major strategies, plans, and policies for climate change response and greenhouse gas reduction. Coordinate international exchanges and cooperation on ecological and environmental protection across the province, fulfill obligations under relevant international treaties, and participate in handling foreign-related ecological and environmental affairs.
(11) Organize and conduct provincial-level ecological and environmental protection inspections. Establish and improve the ecological and environmental protection inspection system, organizing and coordinating provincial-level inspections. Conduct inspections of regional and departmental implementation of central and provincial Party committee decisions on ecological and environmental protection as authorized. Collaborate with relevant departments to support central inspections of the province's ecological and environmental protection efforts.
(12) Unify oversight of ecological and environmental law enforcement. Organize province-wide ecological and environmental protection law enforcement inspections. Investigate and address major ecological and environmental violations. Guide the development and operations of the province's comprehensive ecological and environmental protection administrative law enforcement teams.
(13) Organize, guide, and coordinate ecological and environmental publicity and education. Implement the national ecological and environmental protection publicity and education outline, formulate and implement the provincial ecological and environmental protection publicity and education outline. Organize publicity on ecological and environmental laws and regulations, and promote the participation of social organizations and the public in ecological and environmental protection. Advance ecological and environmental science and technology work, organize major scientific research and technological demonstration projects in ecological and environmental fields, and promote the construction of the ecological and environmental technology management system.
(14) Complete other tasks assigned by the Provincial Party Committee, Provincial Government, and the Ministry of Ecology and Environment.
(15) Transformation of Functions. The Provincial Department of Ecology and Environment shall exercise unified oversight and administrative law enforcement responsibilities for all types of ecological and urban-rural pollution emissions. It shall earnestly fulfill regulatory duties, fully implement action plans for air, water, and soil pollution prevention and control, enforce national policies and measures to substantially reduce the types and quantities of imported solid waste, and cooperate with customs authorities to combat the smuggling of foreign waste into the country. Establish an ecological and environmental governance system led by the government, with enterprises as the main body, and with the participation of social organizations and the public. Implement the strictest ecological and environmental protection system, strictly adhere to ecological protection red lines and environmental quality bottom lines, resolutely fight the battle against pollution prevention and control, safeguard the national ecological security barrier, and build a happy and beautiful new Gansu.
II. Internal Departments and Primary Responsibilities:
(1) Office. Responsible for the daily operations of the agency. Handles information management, confidentiality, confidential documents, archives, petitions, government information disclosure, document drafting, and supervision and follow-up. Manages the construction and operation of the provincial ecological and environmental information network.
(2) Provincial Ecological and Environmental Protection Inspection Office. Monitors the implementation of joint responsibility for Party and government officials and dual responsibilities for each position in ecological and environmental protection. Drafts inspection systems, work plans, and implementation measures for ecological and environmental protection, and organizes their implementation. Coordinates provincial ecological and environmental protection inspections. Assists in coordinating central government inspections of ecological and environmental protection in the province.
(3) Planning and Development Division. Drafts ecological and environmental policies and plans; coordinates and reviews specialized ecological and environmental plans; organizes ecological and environmental statistics, pollution source censuses, and ecological and environmental situation analyses; coordinates and manages comprehensive pollutant emission control; formulates annual ecological and environmental protection targets and assessment plans; leads coordination of the province's pollution prevention and control campaign; oversees ecological and environmental science and technology work. Researches and proposes opinions on comprehensively deepening reforms in the province's ecological and environmental field. Undertakes the daily operations of the Provincial Ecological and Environmental Protection Committee Office.
(4) Regulations and Standards Division. Organizes the drafting of local regulations and provincial government rules concerning ecological and environmental protection. Conducts legal reviews of normative documents within the Department, handles administrative reconsideration and litigation matters, and manages local ecological and environmental standards and technical specifications.
(5) Personnel Division (Retired Cadres Division). Manages cadre personnel affairs, organizational structure and staffing, labor wages, professional title evaluations, cadre education and training, and cadre and talent development for the Department, its派出机构 (dispatch offices), and directly affiliated units. Handles matters related to the dual management of leading cadres in the ecological and environmental protection system and undertakes work related to the reform of the ecological and environmental administration system. Responsible for work concerning senior retired cadres.
(6) Finance and Audit Division. Manages matters related to fixed asset investment and project fund management in the ecological and environmental field. Manages financial affairs, state-owned asset management, and internal auditing for the Department, its派出机构, and directly affiliated units.
(7) Natural Ecological Protection Division. Formulates provincial ecological protection policies and drafts local regulations and provincial government rules. Organizes ecological protection planning, conducts provincial ecological condition assessments, and guides ecological demonstration initiatives. Oversees protected natural areas and ecological protection redline enforcement. Coordinates provincial biodiversity conservation, biological genetic resource protection, and biosafety management.
(8) Water Ecological Environment Division. Oversees provincial surface water ecological environment supervision; formulates and monitors implementation of ecological environment plans for key river basins; establishes and implements cross-regional water quality assessment systems for water sections; supervises ecological environment protection of drinking water sources; guides river discharge outlet placement; organizes implementation of water pollution prevention action plans.
(IX) Air Environment Division. Oversees pollution prevention and control for air, noise, light, and fossil energy across the province. Establishes an assessment system for regional air quality improvement targets. Develops policy measures for responding to heavy pollution events. Coordinates prevention and control of diffuse air pollution sources. Implements the Air Pollution Prevention and Control Action Plan.
(X) Climate Change Response Division. Comprehensively analyzes the impact of climate change on economic and social development. Oversees the province's implementation of national obligations under the United Nations Framework Convention on Climate Change. Organizes and implements the Clean Development Mechanism and clean production audits. Guides and promotes the development of circular economy and eco-environmental industries across the province. Oversees the establishment of green development systems for environmental management in industrial enterprises.
(11) Soil and Ecological Environment Division. Oversees the prevention and control of soil and groundwater pollution, as well as ecological protection across the province. Organizes and guides rural ecological environment protection. Supervises and guides the management of agricultural non-point source pollution. Organizes the implementation of the Soil Pollution Prevention and Control Action Plan.
(12) Solid Waste and Chemicals Division. Oversees the prevention and control of pollution from solid waste, chemicals, heavy metals, and other substances across the province. Implements environmental management systems including hazardous waste operation permits, inter-provincial transfers of solid (hazardous) waste, toxic chemical transfer registrations, and environmental management registrations for new chemical substances.
(13) Nuclear and Radiation Safety Supervision Division. Drafts local regulations and provincial government rules concerning nuclear and radiation safety. Oversees the safety of nuclear facilities and radioactive sources, coordinates nuclear safety mechanisms, and organizes radiation environmental monitoring. Participates in nuclear accident emergency response and handles radiation accident emergency duties. Supervises the control of nuclear materials and the design, manufacturing, installation, and non-destructive testing of civilian nuclear safety equipment.
(14) Environmental Impact Assessment and Emission Management Division. Conducts environmental impact assessments for planning, policies, and projects. Coordinates and manages pollutant discharge permits. Develops and implements the ecological and environmental access list.
(15) Ecological and Environmental Monitoring Division.
Manages ecological and environmental monitoring and releases information on environmental quality and ecological conditions. Organizes ecological and environmental monitoring, greenhouse gas emission reduction monitoring, and emergency monitoring. Investigates and assesses the province's ecological and environmental quality, providing forecasts and early warnings. Oversees the construction and management of the provincial ecological and environmental monitoring network.
(16) Ecological Environment Comprehensive Administrative Law Enforcement Bureau. Oversees the implementation of ecological environment policies, plans, regulations, and standards. Enforces provincial environmental protection permits and investigates/handles major violation cases. Coordinates resolution of cross-regional environmental pollution disputes. Implements the system of simultaneous design, construction, and commissioning of environmental protection facilities for construction projects. Guides the development and operational work of the provincial ecological environment comprehensive administrative law enforcement team.
(17) Environmental Emergency Management Division. Responsible for provincial ecological and environmental emergency management. Organizes the drafting and supervises the implementation of provincial-level emergency response plans for ecological damage incidents. Assists in investigating and handling major and particularly serious environmental pollution accidents and ecological damage incidents, and leads the coordination of investigations and handling for significant environmental pollution accidents and ecological damage incidents. Guides municipal and prefectural environmental emergency management and oversees provincial environmental emergency capacity building.
(18) Publicity and Education Division. Researches, drafts, and implements ecological and environmental protection publicity and education guidelines. Organizes publicity and education efforts for ecological civilization construction and the development of an environmentally friendly society. Undertakes news review and release for the Department, and organizes the collection, analysis, and response to ecological and environmental public opinion.
Party Committee. Responsible for Party building and discipline inspection work within the department and its directly affiliated units. Leads the work of mass organizations such as the labor union, Communist Youth League, and women's federation.
