Lanzhou Municipal Bureau of Justice Functional Information

 The Lanzhou Municipal Bureau of Justice is a municipal government department at the deputy director-general level.


The Office of the Lanzhou Municipal Committee for Comprehensive Law-Based Governance (hereinafter referred to as the Municipal Committee Office for Law-Based Governance) is established within the Municipal Bureau of Justice. It operates under the direct leadership of the Municipal Committee for Comprehensive Law-Based Governance, undertaking the committee's specific duties. This includes organising policy research on major issues concerning comprehensive law-based governance, coordinating and overseeing the implementation of the committee's decisions, work arrangements, and requirements by relevant parties. The internal departments of the Municipal Bureau of Justice undertake relevant tasks for the Municipal Committee Office as required by operational needs, and are subject to the Office's overall coordination.


The principal responsibilities of the Lanzhou Municipal Bureau of Justice are:


(1) To undertake policy research on major issues concerning comprehensive law-based governance of the city; coordinate relevant parties in formulating medium- and long-term planning proposals for comprehensive law-based governance; and oversee the implementation of major policy decisions and deployments.


(2) To assume responsibility for the overall planning of legislative work. To coordinate relevant parties in proposing legislative plans and annual legislative work programmes; to monitor the implementation of legislative work plans by various departments; to strengthen organisational coordination, supervision and guidance; to research and propose opinions and measures for aligning legislation with reform decisions. To solicit proposals from the public for local regulations and government rules.


(iii) Organise the drafting of relevant local regulations and government rules. Handle the review of draft local regulations and government rules submitted by departments to the municipal government. Oversee legislative coordination. Manage the translation and filing of government rules. Review, register, and file administrative normative documents issued by the municipal government, district/county governments, and municipal government departments.


(iv) Conduct post-implementation evaluations of relevant local regulations and government rules. Responsible for coordinating disputes and issues arising from the implementation of local regulations and government rules by districts, counties, and departments. Undertakes the review and compilation of local regulations and government rules drafted by the government. Handles responses to requests for comments on draft laws and administrative regulations.


(v) Assumes responsibility for advancing the rule of law in government administration. Guides and supervises the lawful administration of government departments and districts/counties. Responsible for coordinating administrative law enforcement, undertaking tasks related to advancing administrative law enforcement system reform, and promoting strict, standardised, fair and civilised law enforcement. Handles administrative reconsideration cases submitted to the municipal government, manages litigation cases, and guides and supervises administrative reconsideration and litigation work in districts and counties. Responsible for standardising administrative law enforcement procedures, conduct and discretionary powers; reviews the qualifications of administrative law enforcement entities and personnel in municipal departments; guides and supervises administrative law enforcement work in districts, counties and departments.


(6) Undertakes responsibility for coordinating the planning of a law-based society. In accordance with the unified arrangements of the central, provincial, and municipal Party committees, formulates implementation plans for legal publicity and education, and organises the implementation of legal awareness campaigns. Promotes public participation in and advancement of the rule of law. Guides work on governance according to law and the creation of law-based environments. Guides mediation work and the selection and management of people's jurors and people's supervisors, and advances the development of judicial offices.


(7) Guides and manages community correction work throughout the city. Oversee the rehabilitation and resettlement of released prisoners citywide.


(viii) Manage judicial administrative drug rehabilitation facilities citywide. Guide and supervise the enforcement of compulsory isolation rehabilitation and rehabilitation recovery within the system. Provide guidance, support, and assistance for community-based drug rehabilitation and recovery programmes.


(ix) Formulate and implement the citywide public legal service system development plan, coordinating and allocating legal service resources across urban and rural areas and regions. Guide and supervise the establishment of public legal service centres. Oversee and supervise the work of solicitors, legal aid, judicial appraisal, notarial services, arbitration, and grassroots legal services. Conduct foreign-related legal services in accordance with unified national, provincial, and municipal arrangements.


(10) Responsible for organising and implementing the National Unified Legal Profession Qualification Examination across the city. Oversee the administration of national unified legal profession qualifications and certificates citywide. Organise pre-employment training for legal professionals.


(11) Oversee the municipal government's legal advisory services. Conduct legality reviews of major administrative decisions made by the municipal government. Represent the municipal government in administrative litigation and related legal matters where the municipal government is a civil party. Handle legal consultation matters for the municipal government. Organise theoretical research and publicity efforts concerning the construction of a law-based government.


(12) Manage uniform provisioning, police vehicle administration, and information technology development within the system. Guide and supervise support functions including finance, equipment, facilities, and premises within the system.


(13) To guide Party building, team development, and ideological and political work within the system. To oversee police management and police supervision within the system. To plan, coordinate, and guide the development of legal talent. To guide and supervise Party building within the city's legal services industry. To guide the advancement of spiritual civilisation. To guide the management of retired personnel within the system. To assist district and county authorities in managing leading cadres of judicial bureaus.


(14) To undertake other tasks assigned by the Municipal Party Committee, Municipal Government, and Provincial Department of Justice.
