Tongren Market Supervision and Administration Bureau Functional Information

The Tongren Municipal Market Supervision and Administration Bureau is a department under the municipal people's government, classified as a county-level agency, and also serves as the Tongren Municipal Intellectual Property Bureau. It implements the policies and decisions of the Central Committee of the Communist Party of China, the Provincial Committee, and the Municipal Committee regarding market supervision and administration, as well as intellectual property work. In carrying out its duties, it upholds and strengthens the Party's centralised and unified leadership over market supervision and administration, as well as intellectual property work.


I. Primary Responsibilities:


(1) Oversee comprehensive market supervision and management. Draft normative documents related to market supervision and management and intellectual property rights for the entire city. Implement the Quality-Driven City Strategy, Intellectual Property Rights-Driven City Strategy, Food and Drug Safety Strategy, and Standardisation Strategy. Draft and implement relevant plans to regulate and maintain market order, fostering an honest, trustworthy, and fair competitive market environment.


(2) Responsible for the unified registration and licensing of market entities. Guide the registration and licensing of various types of enterprises, farmers' professional cooperatives, units engaged in business activities, and individual businesses; handle the registration and licensing of market entities such as foreign (regional) enterprise representative offices within its authority. Establish a mechanism for the public disclosure and sharing of market entity information, legally disclose and share relevant information, strengthen credit-based regulation, and promote the construction of a market entity credit system.


(3) Responsible for organising and guiding comprehensive market supervision and law enforcement work. Guide the integration and development of county-level market supervision and law enforcement teams, and promote the implementation of unified market supervision. Coordinate the investigation and handling of major and complex cases and cross-regional law enforcement work. Standardise market supervision and intellectual property administrative law enforcement behaviour.


(4) Responsible for unified anti-monopoly law enforcement within its authority. Coordinate the implementation of competition policies and guide and promote the implementation of the fair competition review system. Conduct anti-monopoly reviews of business concentration activities within its authority, and be responsible for anti-monopoly enforcement work such as monopoly agreements, abuse of market dominance, and abuse of administrative power to exclude or restrict competition in accordance with the law and authorisation. Guide the anti-monopoly defence work of enterprises in Tongren City.


(5) Be responsible for supervising and managing market order. Supervise and manage market transactions, online commodity transactions, and related services in accordance with the law. Organise and guide the investigation and handling of violations of price and fee regulations, unfair competition, illegal direct sales, pyramid schemes, infringement of trademark and patent intellectual property rights, and the production and sale of counterfeit and substandard products. Guide the development of the advertising industry and supervise and manage advertising activities. Guide the investigation and handling of unlicensed production and business operations and related unlicensed production and business operations. Guide the Tongren City Consumer Association in conducting consumer rights protection work and guide the Tongren City Individual and Private Enterprise Association in its work.


(6) Responsible for macro-level quality management. Draft and implement systems and measures for quality development. Coordinate the construction and application of the city's quality infrastructure, work with relevant departments to implement the quality supervision system for major engineering equipment, investigate quality accidents within its authority, implement the defective product recall system, and supervise and manage product anti-counterfeiting work.


(7) Responsible for product quality and safety supervision and management. Manage product quality and safety risk monitoring and municipal-level supervisory spot checks. Implement the quality grading system and quality safety traceability system. Responsible for industrial product production licensing management.


(8) Responsible for the supervision and management of special equipment safety. Comprehensively manage the safety inspection and supervision of special equipment, supervise and inspect the implementation of energy-saving standards for high-energy-consuming special equipment and environmental protection standards for boilers, and be responsible for the investigation and handling of general special equipment accidents.


(9) Responsible for the comprehensive coordination of food safety supervision and management. Organise the formulation and implementation of major food safety policies for the city. Be responsible for the construction of the food safety emergency response system, and organise and guide food safety emergency response and investigation and handling work within its authority. Establish and improve the direct reporting system for important food safety information. Undertake the daily work of the Municipal People's Government Food Safety Committee.


(10) Responsible for food safety supervision and management. Organise and implement food production and operation licensing management, guide the registration management of small food production workshops and small food service establishments, and the filing management of small food vendors. Establish and implement a supervision and inspection system and hazard identification and rectification mechanism covering the entire process of food production, circulation, and consumption to prevent regional and systemic food safety risks. Promote the establishment of mechanisms for food production and operation entities to fulfil their primary responsibilities, and improve the food safety traceability system. Organise and implement food safety supervision and sampling, risk monitoring, verification and disposal, risk warning, and risk communication. Implement supervision and management of special foods.


(11) Be responsible for the unified management of metrology. Promote the use of legal units of measurement and the national metrology system, and manage measuring instruments and the transmission and comparison of measurement values. Standardise and supervise commodity quantities and market metrology practices.


(12) Be responsible for the unified management of standardisation work. Organise the formulation of municipal local standards in accordance with the law. Coordinate, guide, and supervise the formulation of group standards and enterprise standards. Participate in the formulation of international standards, national standards, and provincial local standards, and guide the adoption of international standards.


(13) Be responsible for the unified management of inspection and testing work. Promote the reform of inspection and testing institutions, standardise the inspection and testing market, improve the inspection and testing system, and guide and coordinate the development of the inspection and testing industry.


(14) Be responsible for the unified management, supervision, and comprehensive coordination of certification and accreditation work. Implement the national unified certification and accreditation and conformity assessment supervision and management system.


(15) Be responsible for formulating and implementing policies, measures, and development plans for building a strong city in terms of intellectual property rights. Promote the implementation of management policies and systems for the creation, protection, and utilisation of intellectual property rights. Promote the construction of an intellectual property rights public service system and organise the dissemination and utilisation of intellectual property rights information such as trademarks and patents.


(16) Responsible for protecting intellectual property rights. Implement systems for protecting trademarks, patents, geographical indications of origin, and other intellectual property rights. Study policies for protecting, managing, and serving intellectual property rights in new fields, new business models, and new modes of operation. Implement plans for building an intellectual property rights protection system and promote the construction of such a system. Guide trademark and patent registration and enforcement work, and guide the resolution of intellectual property rights disputes, rights protection assistance, and dispute mediation.


(17) Responsible for promoting the use of intellectual property rights. Implement policies on the use and standardised transactions of intellectual property rights to promote the transfer and conversion of intellectual property rights. Advance intellectual property rights evaluations for major economic activities and related work on overseas transfers. Guide the assessment of intellectual property rights as intangible assets. Promote the development of the intellectual property rights service industry. Coordinate major intellectual property rights-related activities.


(18) Responsible for science and technology, informatisation, news publicity, emergency response, and public opinion monitoring in market supervision and management. Undertake technical trade measures-related work in accordance with regulations.


(19) In conjunction with departmental responsibilities, carry out relevant work related to military-civilian integration and poverty alleviation. Increase investment in science and technology, enhance scientific and technological innovation capabilities, and provide support for the promotion of innovation-driven development. Be responsible for work safety and fire safety within this department and industry sector. Carry out relevant work related to big data development and application and government data resource management in accordance with regulations, and promote the standardised management, sharing, and openness of departmental government data resources in accordance with the law.


(20) Be responsible for the licensing, inspection, and enforcement of penalties related to the retail sale of pharmaceuticals (including traditional Chinese medicine and ethnic medicine, as applicable) and the operation of medical devices. Be responsible for the inspection and enforcement of penalties related to the operation of cosmetics and the quality of pharmaceuticals and medical devices during use. Undertake tasks delegated or assigned by the Provincial Drug Administration Bureau.


(21) Complete other tasks assigned by the Municipal Party Committee, Municipal Government, and Provincial Market Supervision Administration Bureau (Provincial Intellectual Property Bureau).
