Qiannan Prefecture Market Supervision Administration Functional Information

The Qiannan Buyi and Miao Autonomous Prefecture Market Supervision Administration is a functional department of the Prefectural People's Government at the county level, also serving as the Qiannan Buyi and Miao Autonomous Prefecture Intellectual Property Office. (Hereinafter referred to as the Prefectural Market Supervision Administration [Prefectural Intellectual Property Office])


The Prefectural Market Supervision Administration (Prefectural Intellectual Property Office) implements the guiding principles, policies, and decisions of the Central Committee of the Communist Party of China, the Provincial Party Committee, and the Prefectural Party Committee regarding market supervision and intellectual property work. In performing its duties, it upholds and strengthens the Party's centralized and unified leadership over market supervision and intellectual property affairs. Its primary responsibilities are:


Comprehensive Market Supervision and Administration. Implement laws, regulations, and policies concerning market supervision and administration, intellectual property, and other related areas. Organize and implement strategies for strengthening the prefecture through quality, intellectual property, food safety, and standardization. Draft and implement relevant plans to regulate and maintain market order, fostering a market environment characterized by integrity, trustworthiness, and fair competition.


Unified Registration of Market Entities. Guide the registration of all types of enterprises, farmer cooperatives, business entities, individual industrial and commercial households, and permanent representative offices of foreign (regional) enterprises. Establish mechanisms for public disclosure and sharing of market entity information, disclose and share relevant information in accordance with the law, strengthen credit-based supervision, and promote the development of a market entity credit system.


Organize and guide comprehensive market supervision and law enforcement. Guide the integration and development of county (city) market supervision and law enforcement teams, and promote unified market supervision. Coordinate case investigations and cross-regional law enforcement. Standardize administrative law enforcement practices in market regulation and intellectual property.


Conduct unified antitrust enforcement within its jurisdiction. Coordinate the implementation of competition policies, guiding and promoting the fair competition review system. Conduct antitrust reviews of business concentration activities within its authority, and handle antitrust enforcement matters such as monopolistic agreements, abuse of market dominance, and abuse of administrative power to exclude or restrict competition in accordance with the law and delegated authority. Guide Qiannan Prefecture enterprises in defending against antitrust lawsuits abroad.


Oversee market order supervision. Legally supervise market transactions, online commodity transactions, and related services. Organize and guide investigations into illegal pricing and fee practices, unfair competition, illegal direct selling, pyramid schemes, trademark/patent infringement, and counterfeit/substandard product manufacturing/sales. Guides the development of the advertising industry and oversees advertising activities. Directs investigations into unlicensed production and operation activities and related uncertified production and operation practices. Guides the Qiannan Prefecture Consumers Association in consumer rights protection work.


Responsible for macro-level quality management. Drafts and implements institutional measures for quality development; coordinates the construction and application of the prefecture-wide quality infrastructure; organizes and coordinates investigations into quality incidents; implements the defective product recall system and oversees product anti-counterfeiting efforts.


Oversee product quality and safety supervision. Manage product quality risk monitoring and prefectural-level supervisory sampling. Implement quality grading systems and quality safety traceability systems. Administer industrial product production licensing. Supervise fiber quality.


Oversee safety supervision of special equipment. Conduct safety inspections and supervision of special equipment; organize investigations into special equipment accidents. Monitor compliance with energy efficiency standards for high-energy-consuming special equipment and environmental protection standards for boilers.


Comprehensive coordination of food safety supervision and management (including alcoholic beverages, as applicable). Organizes the formulation and implementation of major food safety policies across the prefecture. Responsible for building the food safety emergency response system, organizing and guiding emergency handling and investigation of food safety incidents. Establishes, improves, and implements a direct reporting system for critical food safety information. Undertakes the daily operations of the Prefectural People's Government Food Safety Committee.


Oversee food safety supervision and management. Establish and implement a comprehensive inspection system and hazard identification/mitigation mechanism covering the entire food production, distribution, and consumption chain to prevent regional and systemic food safety risks. Promote mechanisms for food producers and operators to fulfill their primary responsibilities and improve the food safety traceability system. Organize food safety supervision sampling, risk monitoring, verification and disposal, risk warning, and risk communication. Implement supervision and management of special foods. Assume responsibilities for salt safety supervision and management. Assume responsibilities for alcoholic beverage market supervision and management.


Responsible for the unified management of measurement. Promote the use of legal measurement units and the national measurement system, manage measuring instruments, and oversee the transmission and comparison of measurement values. Regulate and supervise commodity measurement and market measurement practices.


Responsible for the unified management of standardization. Organize the drafting of prefectural-level local standards in accordance with the law, coordinate, guide, and supervise the formulation of local standards, group standards, and enterprise standards throughout the prefecture, and organize their implementation. Participate in the formulation of international standards, national standards, and local standards, and organize the adoption of international standards.


Responsible for the unified management of inspection and testing. Promotes the reform of inspection and testing institutions, regulates the inspection and testing market, improves the inspection and testing system, and guides and coordinates the development of the inspection and testing industry.


Responsible for the unified management, supervision, and comprehensive coordination of certification and accreditation. Implements the nationally unified certification and accreditation supervision and management system.


Responsible for formulating and implementing policy measures and development plans for building a strong intellectual property (IP) prefecture. Advances the implementation of management policies and systems for IP creation, protection, and utilization. Advance the construction of the intellectual property public service system and organize the dissemination and utilization of intellectual property information such as trademarks and patents.


Responsible for protecting intellectual property. Organize and implement systems for protecting intellectual property such as trademarks, patents, and geographical indications of origin. Research policies for intellectual property protection, management, and services that encourage innovation in new fields, new business models, and new formats. Organize and implement plans for building an intellectual property protection system and promote the construction of such a system. Responsible for guiding trademark and patent registration and enforcement work, as well as guiding the handling of intellectual property disputes, rights protection assistance, and dispute mediation.


Promote the utilization of intellectual property. Implement policies for intellectual property utilization and standardized transactions, advancing the transfer and transformation of intellectual property. Promote intellectual property evaluation for economic activities and related work on external transfers across the prefecture. Guide the assessment of intellectual property intangible assets. Foster the development of intellectual property services. Coordinate and integrate work related to intellectual property activities.


Oversee the safety supervision and management of pharmaceuticals (including traditional Chinese medicine and ethnic medicines, as applicable), medical devices, and cosmetics. Drafts and oversees the implementation of regulatory policies and plans; implements management and service policies encouraging new technologies and products in pharmaceuticals, medical devices, and cosmetics.


Issues licenses for pharmaceutical retail and medical device operations. Oversees the implementation of national pharmacopoeia standards and other pharmaceutical, medical device, and cosmetic standards, as well as the classification management system. Assists in implementing the national essential medicines system.


Conducts inspections and enforces penalties for pharmaceutical retail and medical device operations, as well as for cosmetic operations and the quality of pharmaceutical and medical device usage.


Organize the monitoring, evaluation, and handling of adverse drug reactions, adverse medical device events, and adverse cosmetic reactions. Undertake emergency management for drug, medical device, and cosmetic safety in accordance with the law.


Oversee market regulation science and technology development, informatization, news publicity, emergency response, and public opinion monitoring.


Provide guidance to market regulation departments in counties (cities).


In accordance with departmental responsibilities, advance related work in areas such as military-civilian integration and poverty alleviation. Increase investment in science and technology to enhance innovation capabilities, providing support for innovation-driven development. Oversee work safety and fire safety within the department and its industry sectors.


Perform duties related to big data development and application, as well as government data resource management in accordance with regulations. Promote the standardized management, sharing, and openness of departmental government data resources in accordance with the law.


Complete other tasks assigned by the Prefectural Party Committee, Prefectural Government, Provincial Market Supervision Administration (Provincial Intellectual Property Office), and Provincial Drug Administration.
