Lanzhou Municipal Market Supervision Administration Functional Information

(i) Overseeing comprehensive market supervision and administration. Implementing national and provincial laws, regulations, and policies governing market supervision; drafting local regulations, municipal government rules, and relevant policies on market supervision. Organising the implementation of strategies for quality-driven development, food safety, and standardisation; formulating and executing related plans; regulating and safeguarding market order; fostering a market environment characterised by integrity, trustworthiness, and fair competition.

(2) Overseeing the unified registration of market entities. Guide the registration of all market entities across the city, including enterprises, farmers' professional cooperatives, units engaged in business activities, individual industrial and commercial households, and permanent representative offices of foreign (regional) enterprises. Establish mechanisms for the disclosure and sharing of market entity information, legally publicise and share relevant data, strengthen credit-based regulation, and advance the development of a market entity credit system.

(iii) Organising and guiding comprehensive market regulation enforcement. Coordinating the integration and development of the city's comprehensive market regulation enforcement teams to advance unified market oversight. Investigating and handling violations and cases involving market entities, while standardising administrative law enforcement practices in market regulation.

(iv) Oversee unified anti-monopoly enforcement. Coordinate the implementation of competition policy and administer the fair competition review system. Conduct anti-monopoly reviews of business concentration activities in accordance with the law and authorised powers. Manage anti-monopoly enforcement concerning monopolistic agreements, abuse of market dominance, and the abuse of administrative power to exclude or restrict competition.

(v) Supervise and regulate market order. Oversee market transactions, online commodity trading, and related services in accordance with the law. Organise and direct investigations into violations of pricing and charging regulations, unfair competition, illegal direct selling, pyramid schemes, infringement of trademark and patent intellectual property rights, and the manufacture and sale of counterfeit and substandard goods. Organise and implement the supervision and management of contracts and auction activities in accordance with the law; manage the registration of movable property mortgages; and cooperate in anti-smuggling law enforcement activities. Guide the development of the advertising industry and supervise advertising activities. Undertake the investigation and handling of unlicensed production and business operations and related uncertified production and business activities in accordance with the law. Guide the Municipal Consumers' Association in carrying out consumer rights protection work.

(6) Oversee macro-level quality management. Formulate and implement institutional measures for quality development. Advance the construction and application of quality infrastructure. Collaborate with relevant departments to implement quality supervision systems for major engineering equipment. Organise investigations into significant quality incidents. Implement defective product recall systems. Supervise product anti-counterfeiting efforts.

(7) Oversee product quality and safety supervision. Conduct product quality spot checks and risk monitoring. Implement quality grading systems and quality safety traceability systems. Oversees post-licensing supervision of industrial product production permits.

(8) Oversees the safety supervision of special equipment. Comprehensively manages safety inspections and supervision of special equipment, monitoring compliance with energy-saving standards for high-energy-consumption special equipment and environmental protection standards for boilers.

(9) Coordinates comprehensive food safety supervision. Implements major food safety policies and organises their execution. Oversees the development of food safety emergency response systems, organising and guiding emergency handling and investigation of significant food safety incidents. Implements the direct reporting system for critical food safety information. Undertake the daily operations of the Municipal Food Safety Committee.

(10) Oversee food safety supervision and management. Establish and implement a comprehensive inspection system and hazard identification and rectification mechanism covering the entire food production, distribution, and consumption chain to prevent regional and systemic food safety risks. Promote the establishment of mechanisms for food producers and operators to fulfil their primary responsibilities and improve the food safety traceability system. Organise and implement food safety supervision sampling, risk monitoring, verification and disposal, risk warning, and risk communication. Implement supervision and management of special foods.

(11) Oversee the safety supervision of pharmaceuticals (including traditional Chinese and ethnic medicines, hereinafter the same), medical devices, and cosmetics during the distribution phase. Implement national laws, regulations, and rules governing the safety supervision of pharmaceuticals, medical devices, and cosmetics; draft relevant local regulations, municipal government rules, and policy plans, and oversee their implementation; supervise the implementation of management systems for pharmaceuticals, medical devices, and cosmetics; collaborate with relevant departments in implementing the national essential medicines system; undertake emergency management responsibilities for pharmaceutical, medical device, and cosmetic safety in accordance with the law.

(12) Oversee the quality management of pharmaceuticals, medical devices, and cosmetics. Supervise the implementation of quality management standards for pharmaceutical and medical device distribution, and enforce hygiene standards and technical specifications for cosmetic distribution (excluding pharmaceutical wholesalers, retail chain headquarters, and third-party internet sales platforms) and usage. Manage post-market risks for pharmaceuticals, medical devices, and cosmetics. Organise the monitoring, evaluation, and handling of adverse drug reactions, adverse medical device events, and adverse cosmetic reactions. Organise and implement supervision and inspection of pharmaceuticals, medical devices, and cosmetics; investigate and penalise illegal activities in the operation (excluding pharmaceutical wholesale, retail chain headquarters, and third-party internet sales platforms) and use of pharmaceuticals, medical devices, and cosmetics in accordance with the law; oversee the implementation of recall and disposal systems for problematic products; and organise and guide the investigation and handling of illegal activities in other stages.

(13) Oversee metrology management. Promote the use of statutory units of measurement and the national measurement system; manage measuring instruments and their traceability and comparison. Organise metrological arbitration verification and mediate measurement disputes. Regulate and supervise commodity quantities and market measurement practices.

(14) Oversee standardisation work. Advance the implementation and enforcement supervision of mandatory national standards. Undertake the establishment, numbering, and publication of local standards in accordance with the law, and coordinate and guide the formulation of municipal-level local standards and group standards. Manage the daily operations of the Municipal Leading Group for Advancing Standardisation Development Strategy.

(15) Oversee inspection and testing work. Regulate the inspection and testing market, improve the inspection and testing system, and guide and coordinate the development of the inspection and testing industry.

(16) Oversee, supervise, and coordinate certification and accreditation activities. Manage supervision of certification, accreditation, and conformity assessment.

(17) Manage science and technology advancement, information infrastructure development, and publicity for market supervision. Undertake technical trade measures duties as stipulated.

(18) Implement national laws, regulations, policies, and guidelines protecting intellectual property rights including trademarks, patents, and geographical indications. Draft and implement municipal intellectual property development plans, policies, and systems. Coordinate foreign-related intellectual property matters and oversee external liaison and cooperative exchanges. Oversee intellectual property protection, including the investigation and handling of infringements, dispute resolution, rights protection assistance, and mediation of disputes. Supervise the management of trademark printing enterprises. Promote the utilisation and management of intellectual property, including property rights confirmation, infringement determination, and application-related work. Standardise and guide the valuation of intangible assets related to intellectual property. Explore the establishment of a public service system for intellectual property and advance the utilisation and service provision of patent information.
